BATTLE OF THE BOOM TERMS & CONDITIONS

Terms and Conditions Battle of the Boom (“the Competition”) is organised by Hausboom (“Organizer”, “we” or “our”). By participating in the Competition, the participant (“the Participant” or “you”) agrees to unconditional acceptance of the following terms and conditions. The singular term “Participant” shall also import the plural and vice versa. Further information on the Competition can be found at: www.hausboom.com/battleoftheboom

 

  1.  Eligibility

  1. This Competition is open to all Participants sixteen (16) years old and above as of 1 February 2021. 

  2. This Competition is free to enter.

  3. Participants must Be residing in Malaysia, Indonesia, Singapore and Brunei. 

  4. Participants must register as a group of at least two (2) members (“Group”). Solo Participants will be disqualified (at Hausboom’s sole discretion). 

  5. This Competition is open to all Participants whether they have not signed a contract with a record company, or any contract with any third party record label, any contract for performance with a live music venue or any other similar arrangement. To avoid doubt:

    1. If you are a Participant who is contracted to, and is currently performing live music at any venue on a regular basis, you are allowed to participate in the Competition; 

    2. Participants who have self-released material (whether in a physical format, a digital format or otherwise) are also allowed to participate in the Competition. For the purposes of this clause, “self-released” shall mean a recording that is fully financed by the Participant without any financial assistance from any record company, record label, commercial organisation or other investor, but does not include a distribution deal entered into with music distributors such as iTunes, Google Music and Spotify.  

  6. Participants must own at least two (2) original songs. 

    1. Song must be an original song written by the Group, any member of the Group, or any of the Participants. The song must not be a cover or interpretation of existing songs already published. Otherwise, the Group shall be disqualified.

  7. Agree to perform at our Battle of the Boom Finale at ATASbyBIJAN (Live Streaming) on 10 April 2021* (Depending on the situation, the Participants will need to come and pre-record the performances) - Participants from Singapore, Indonesia and Brunei will need to be pre-recorded in their respective countries.

 

  1.  Registration

  1. Entries will be accepted online only from 1 February 2021 to 21 February at www.hausboom.com/battleoftheboom

  2. Each Group will need to submit:

    1. ONE (1) video format file, direct link on Youtube, Vimeo or any other similar service to a video of the Group performing. 

      1. You must provide the link in a format accessible by Hausboom at any time during the Competition. 

      2. The video must be of your Group performing one (1) song live in any genre.

    2. One (1) photo of the Group, pre-cleared for all media uses

    3. Details of the Group such as Lead contact person of the Group, Band Name, Nationality, Address, Email and Phone Number for contacting purposes and must be pre-cleared for all media uses.

    4. A brief description of the Group. The description must not be longer than one hundred (100) words and must be pre-cleared for all media uses

  3. All Submissions to be filled on the website www.hausboom.com/battleoftheboom . An automatic email will be sent to the Group to confirm your acknowledge your submission

  4. Please make sure that the Submission is clear and complete. You cannot amend the Submission once it has been submitted. This includes

    1. changing the number of Participants in the Group;

    2. making changes to the Participants in the Group; or

    3. submitting additional songs to us. Please do not send us additional links after the Submission has been sent to us. 

  5. By submitting the Submission: 

    1. the Group agrees that any part of the Submission and any subsequent live performance (as more particularly set out at parts 2A- 2D above) may be used, reproduce, broadcast or streamed by the Organizer through whatever media channel or format, without further consultation; 

    2. the Group warrants and declares that jointly and severally, it possesses and the sole and unfettered copyright to the Submission.

 

  1.  Selection Rounds

  1. Open Voting (Audition Stage)

    1. Selected Groups (“Shortlisted Groups”) will be shortlisted by the Organizer and panel of commentators (“Commentator”).

    2. The Shortlisted Groups will be contacted via phone and/or email. 

    3. The Shortlisted Groups will be randomly assigned into 4 Batches. 

    4. The Shortlisted Groups submission video will be uploaded to the Hausboom Music (@hausboommusic) Instagram account according to their Batch. 

    5. The announcement on the Selected Groups will be made between 23 Feb - 15 March 2021. Schedule of results of voting will be as follows:

      1. Batch 1 : 23rd Feb 2021

      2. Batch 2 : 28th Feb 2021

      3. Batch 3 : 5th March 2021

      4. Batch 4 : 10th March 2021

    6. Selected Groups will be shortlisted to Semi Finals based on Instagram likes (“Open Voting”) and the panel of commentators (“Commentator”).

 

  1. Battle of the Boom Semi-Finals 

    1. Battle of the Boom (BOTB) Semi Finals (“Semi Finals”) will take place on 22 - 28 March 2021. 

    2. Only fifteen (15) Selected Groups will be chosen.

    3. Semi Final entries will be accepted online only from 16 March to 20 March 11:59 PM at www.hausboom.com/battleoftheboom 

    4. Each Group will need to submit:

      1. ONE (1) video format file, direct link on Youtube, Vimeo or any other similar service to a video of the Group performing. 

        1. You must provide the link in a format accessible by Hausboom at any time during the Competition. 

        2. The video must be of your Group performing one (1) ORIGINAL song live in any genre. This song can be the same song used in the Open Voting (Auditions Stage) or it can be a different song. 

        3. Song must be an original song written by the Group, any member of the Group, or any of the Participants. The song must not be a cover or interpretation of existing songs already published. Otherwise, the Group shall be disqualified.

        4. The performance of the Selected Group during the Semi Finals must be original and the Contestant will not breach or infringe any proprietary rights, intellectual property rights or copyrights belonging to any third parties nor contain any act or words that shall be defamatory, obscene or profane.  

      2. Details of the Group such as Lead contact person of the Group, Band Name, Nationality, Address, Email and Phone Number for contacting purposes and must be pre-cleared for all media uses.

      3. A brief description of the Group and Semi Final Song entry. The description must not be longer than one hundred (100) words and must be pre-cleared for all media uses.

    5. All entries to be filled on the website www.hausboom.com/battleoftheboom . An automatic email will be sent to the Group to confirm your acknowledge your submission

    6. Please make sure that the Submission is clear and complete. You cannot amend the Submission once it has been submitted. This includes

      1. changing the number of Participants in the Group;

      2. making changes to the Participants in the Group; or

      3. submitting additional songs to us. Please do not send us additional links after the Submission has been sent to us. 

    7. By submitting the Submission: 

      1. the Group agrees that any part of the Submission and any subsequent live performance may be used, reproduce, broadcast or streamed by the Organizer through whatever media channel or format, without further consultation; 

      2. the Group warrants and declares that jointly and severally, it possesses and the sole and unfettered copyright to the Submission.

    8. Entries will be accepted online only until 11:59PM on 28 March 2021. 

    9. Selected Groups will be shortlisted to the Finals based on Instagram likes (“Open Voting”) and the panel of Judges overall score.

    10. The score is based on a 7:3 judging ratio which comprises of:

      1. Judges selection to comprise 70% of the overall score.

      2. Instagram Likes Open votes to comprise 30% of the overall score. 

 

  1. Battle of the Boom Finals 

    1. Battle of the Boom (BOTB) Finals (“Finals”) will take place on 29 March 2021.

    2. Only five (5) Selected Groups will be chosen.

    3. Final entries will be accepted online only from 30 March to 4th April 11:59 PM at www.hausboom.com/battleoftheboom 

    4. Each Group will need to submit:

      1. ONE (1) video format file, direct link on Youtube, Vimeo or any other similar service to a video of the Group performing. 

        1. You must provide the link in a format accessible by Hausboom at any time during the Competition. 

        2. The video must be of your Group performing one (1) ORIGINAL song live in any genre. The song submitted must be a different song used in the Open Voting (Auditions Stage) or the Semi Finals. The song cannot be reused for the Finals.

      3. Entries will be accepted online only until 11:59PM on 30 March 2021. 

    8. The winner will be chosen based on Instagram likes (“Open Voting”) and the panel of Judges overall score.

    9. The score is based on a 7:3 judging ratio which comprises of:

      1. Judges selection to comprise 70% of the overall score.

      2. Open Voting to comprise 30% of the overall score. 

 

  1.  Judging Criteria

  1. The judging criteria for the Selection Round (“Selection Round Judging Criteria”) will consist of the following: 

    1. Judges Score;

    2. Open Voting (Instagram Likes)

  2. There will be four categories of judging. Each category is worth up to 30 points. At the end of each performance the points will be totaled with each Judge’s scores to get the band’s overall final score.

  3. In respect of the Judges Points component of the Selection Round Judging Criteria, Performances will be evaluated by the Judging Panel based on the following:

    1. Planning/Preparedness - 30 Points

    2. Musicianship/Creativity - 30 Points

    3. Quality of Performance - 30 Points

  4. In respect of the Open Voting component of the Selection Round Judging Criteria, Performances will be evaluated based on the following: 

    1. Instagram Likes will be converted to points. 

    2. Shortlisted Groups will be awarded points pro-rated according to their percentage of the Audience Votes. 

  5. The Shortlisted Group who has the highest combined total of the Judges Score and Open Votes will be the winner of that particular Selection Round. The winner of that particular Selection Round will move on to the Final Round (as defined in clause D below).  

  6. All decisions by the Judging Panel and the Organizer concerning the Selection Round are final and irrevocable.

 

  1.  The Finals

    1. The five (5) Selected Group that made it past the Semi Finals are called the Finalist Group. Finalist Groups will perform live at ATASbyBIJAN (Live Streaming) on 10 April 2021* (Depending on the situation, the Participants will need to come and pre-record the performances) - Participants from Singapore, Indonesia and Brunei will need to be pre-recorded in their respective countries to select the ultimate winner of the Competition (“Final Round”). 

    2. Depending on the current Covid-19 situation, if the performance at ATASbyBIJAN is not possible, a livestream platform will be established for the Final Round. 

    3. Finalist Groups must make themselves available during the Final Round and neither the Organizer nor the Judging Panel shall be obliged to entertain any request for a change of date for the Final Round. 

 

  1.  The Prizes

    1. The First Place Winner (“Winner”) will: 

      1. a. Receive RM10,000 in cash. 

    2. The Second Place Winner (“Winner”) will:

      1. Receive RM3,000 in cash.

    3. The Third Place Winner will:

      1. Receive RM2,000 in cash. 

    4. The #INILAGIBOOM Award is given to a Group chosen by ASET Records to become a recording contract artist under ASER Records. 

    5. ASET Records will be monitoring the process of the Competition from the Semi Final to Finals. 

    6. The #INILAGIBOOM Award is open only to Participants who have not signed a contract with a record company, or any contract with any third party record label, any contract for performance with a live music venue or any other similar arrangement.


 

  1.  General

    1.  Battle of the Boom, the Sponsors, the Organisers, the Jury and Commentators are not responsible for any faults in transmission or reception during the submission/uploading process.

    2. By entering the contest, participants acknowledge and have indicated that they are bound by these Terms and Conditions.

    3. The Organizer reserves the right to change these Terms and Conditions at any point of time, and reserve the right to have the final jurisdiction in the occurrence of any disputes.

    4. The Organizer reserves the right at any time in its absolute discretion and without prior notice to exclude a participant from any further participation in the contest.

    5. The performance of the Groups during the Competition shall be original and the Contestant will not breach or infringe any proprietary rights, intellectual property rights or copyrights belonging to any third parties nor contain any act or words that shall be defamatory, obscene or profane;  

    6. The Organizers are not liable for any injuries and mishaps during the live streaming performance on 10 April 2021.

    7. The Jurys’ decision is final. The Organizers reserves their rights to make any changes and amendments to the terms and conditions at any time.

    8. Winners will agree to appear for publicity and marketing materials, as well as appearing for media interviews as needed and indicated by the Organizer. 

 

  1.  Grant of rights

  1. In consideration of the Organiser granting to the Contestants the opportunity to participate in the Competition and the opportunity to appear in the Hausboom Music (@hausboommusic) Instagram account, the Contestants unconditionally and irrevocably:- 

    1. agrees and consents to the photographing, filming and recording of the Contestant and the Contestant’s voice and performance and that the photographs, video footage and sound recording may be incorporated in the Competition and/or the Instagram in whole or in part at the Organiser’s discretion.

    2. consents, grants, assign and transfer to the Organiser the exclusive worldwide rights (without remuneration to the Contestant and royalty-free) to use, reproduce and exploit the names, photographs, voice, performance, sound recordings and audio-visual recordings of the performance of the Contestant or any part thereof and all other products resulting from the Contestant’s participation in the Competition.

    3. agrees that the Organiser shall have full charge and control of the manner in which the Competition shall be produced, marketed, used, distributed, throughout the world, if at all. 

    4. agrees that the personal data of the Contestant may be collected, processed, stored and otherwise used for the purposes of conducting and administering the Competition and used in the ordinary course of the Organiser’s business as it sees fit. 

    5. Consents and agrees for Organizer to sell, copy, reproduce, to the public by distributing to digital internet consumer stores including but not exhaustive, Spotify, Apple Music, Amazon and/or any other digital retailers of music which the Organizer has the licensing agreement with (whether now known or existing in the future) of said performance.

    6. Consents the Organizer to collect all income deriving therefrom; and

    7. to use the name(s), photographs and likenesses, artwork images, biographical and other information provided by the Contestants whose performances are embodied on the Recordings in connection with the Recordings and Company’s general business.

 

  1. Covenant of Good Faith and Fair Dealing. Each Party agrees to act in good faith in dealing with one another pursuant to this Agreement. Each Party hereby covenants to the others that it shall not undermine the rights of the other Party hereto with respect to the Agreement and will cooperate with each other in achieving the goals of this Agreement; provided, however, that nothing in the foregoing will be deemed to limit or otherwise affect the rights of a Party to terminate this Agreement or seek remedies for defaults hereunder, all as provided for in this Agreement.

  2. How can my band join Battle of The BOOM?

    1. Your band can fill up the form at www.hausboom.com/battleoftheboom to go to the auditioning stage. Auditions are open from 1 - 14 February 2021.

  3. Who can join Battle of the BOOM?

    1. We welcome all bands of all genres from Malaysia, Indonesia, Singapore and Brunei!

  6. Can I submit a cover of a song?

    1. We only accept original songs for this competition. Strictly no copyrighted songs are allowed. You can read the terms and conditions to read in more detail.

  7. Do I need to pay to join?

    1. Admission is FREE of charge

  8. How does the voting process work?

    1. The points are calculated based on a 70:30 ratio. 70% of the votes comes from the professional jury and commentators whilst the 30% comes from public voting based on Instagram likes.

  9. Who is the professional jury and commentator?

    1. We have a talented line of professional juries and commentators that will judge, provide feedback and determine who makes the cut to the next round.

    2. Our juries are AG Coco music producer and guitarist for Malaysian rock band Hujan, Youk a songwriter and bassist for Malaysian rock band Bunkface and Qi Razali foodie TV Host/presenter emcee and drummer for Malaysian indie rock band OAG. Our commentator is Alif Satar & the Locos, a rock band from Malaysia

  10. Tell me more on the recording contract with ASET Records

    1. ASET Records will be monitoring the whole competition from day 1. The #INILAGIBOOM award rewards 1 special band a recording contract with ASET Records. The chosen band must not be tied to any other recording label.
